These Terms of Service ("Terms") govern your use of WorkForce On Deck, a service of Starboard Investments ("Company," "we," "us," or "our"), located in Birmingham, Alabama, USA. By accessing our website at workforceondeck.com or using our services, you agree to be bound by these Terms.

WorkForce On Deck provides international talent vetting, placement, and management services connecting US businesses ("Clients") with pre-vetted candidates from the Philippines, El Salvador, and other countries ("Candidates"). Our services include:
- Candidate sourcing, screening, and vetting
- Skills assessment and video interviewing
- Background checks and verification
- Matching and placement with Client businesses
- Ongoing placement support and management
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.
3. User Accounts and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete information when creating your account
- Promptly update your information if it changes
- Notify us immediately of any unauthorized use of your account
- Not share your account credentials with others
- Not use our services for any unlawful purpose
4. Client Obligations
Clients using WorkForce On Deck to hire talent agree to:
- Honest job descriptions — provide accurate, complete, and lawful descriptions of roles, responsibilities, compensation, and working conditions
- Payment terms — pay all fees and invoices according to the agreed payment schedule; late payments may result in service suspension
- Legal compliance — comply with all applicable employment laws in their jurisdiction when engaging placed candidates
- Professional conduct — treat candidates with respect and dignity; any form of harassment or discrimination is prohibited
- Confidentiality — protect candidate personal information and use it only for legitimate hiring purposes
5. Candidate Obligations
Candidates applying through WorkForce On Deck agree to:
- Accurate information — provide truthful and complete information in all applications, assessments, and interviews; falsification is grounds for immediate disqualification or termination
- Professional conduct — conduct yourself professionally during all assessments, interviews, and placements
- Availability and reliability — honor commitments made to clients and communicate proactively about any issues affecting your work
- Compliance — comply with all reasonable workplace policies of placed clients
- Background checks — consent to background verification as part of the vetting process
6. Intellectual Property
All content on workforceondeck.com, including text, graphics, logos, images, and software, is the property of WorkForce On Deck or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
By submitting content to us (such as a resume or application), you grant us a non-exclusive, worldwide license to use that content for the purpose of providing our services.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKFORCE ON DECK AND STARBOARD INVESTMENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
Our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the fees paid by you to us in the three months preceding the claim.
We do not guarantee employment for any candidate, nor do we guarantee that any candidate will meet a client's specific requirements. We make reasonable efforts to vet candidates but cannot guarantee the accuracy of all information provided by candidates.
8. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Alabama, USA, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of our services shall first be subject to good-faith negotiation. If the dispute cannot be resolved informally within 30 days, the parties agree to binding arbitration in Birmingham, Alabama, under the rules of the American Arbitration Association.
You waive any right to participate in class action lawsuits or class-wide arbitration.
9. Termination
We may terminate or suspend your access to our services at any time, with or without cause, with reasonable notice. You may also terminate your account at any time by contacting us.
Upon termination, your right to use our services ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, liability limitations, and dispute resolution) will survive.
10. Modifications to Terms
We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. Your continued use of our services after the effective date constitutes your acceptance of the updated Terms.
11. Disclaimer of Warranties
